Post subject:  Locations entitled to compensation from BT re: split?

Thanks to BT sending out an email today re: the split, I see new players and locations coming forward to protest. Kevin Hebert raised an interesting point: what if the locations who are current subscribers ask for compensation from BT for the devaluing of the product from one that allowed system-wide competition to one that only allows regional? In addition, I can see the West zone locations being entitled to additional compensation because they're getting repeat content games. In other words, locations don't have to go so far as to pull the system to show their unhappiness with the changes.

It all comes down to the terms of the contract. And since Buzztime writes the contract, I'm betting that the only remedy the sites have if they don't like how the program is run is to terminate the relationship.

As a former contracts attorney, I agree that it comes down to the language. And there's probably lots of language giving BT the freedom to drop or add games, change game format, etc. But this goes to an essential element of the system, one which the location reasonably relied upon in agreeing to have the system installed and in incurring any associated expenses, including any promotions.

As a practicing attorney - I think there may be wiggle room. If the product is essentially a DIFFERENT PRODUCT, the contract hardly applies.
